1. Binding agreement

These Terms of Use are a binding contract between you and OmniPlay LLC, an Arizona limited liability company. By creating an account, checking “I agree,” starting a trial, or using Brickz Daily in any way, you accept these terms. If you do not agree, do not create an account and do not use the service.

2. Who we are / what Brickz Daily is

Brickz Daily (including Brickz Daily) is a product of OmniPlay LLC. It is an information product only. We publish one sports pick per calendar day, plus the analysis behind it.

Brickz Daily is not a sportsbook, casino, wagering platform, payment processor for bets, or gambling operator. We do not accept bets, hold stakes, transmit wagers, or pay winnings. We do not link to sportsbooks.

We may show third-party American odds labeled with the sportsbook that posted them, delivered by a licensed odds feed we name on the page. That is market information, not our line, not an offer to take a bet, and not a link to place a wager. OmniPlay LLC is not affiliated with DraftKings or any sportsbook. If we show public ticket or money percentages, those are unofficial third-party estimates for entertainment only. They are not official sportsbook counts. If we do not have a number, we hide the meter. None of that is a recommendation to wager. Pick copy, factors, and recaps still use official feeds only.

3. Eligibility / 21+

You must be at least 21 years old to use Brickz Daily or subscribe. By creating an account, checking “I agree,” starting a trial, or using the service, you represent and warrant that you are 21 or older, that you have legal capacity to enter this contract, and that receiving this information is lawful where you live.

We may terminate your account immediately if we believe you are under 21. We have no duty to independently verify your age, but we may request proof. Use of Brickz Daily is void where prohibited.

4. Not advice; no fiduciary duty

Picks, analysis, confidence reads, and related content are opinions offered as entertainment and information. They are not betting advice, not financial advice, and not a recommendation to place a wager. OmniPlay LLC is not your agent, advisor, or fiduciary.

5. Assumption of risk / no wagering through Brickz Daily

You may not place a wager through Brickz Daily. Any wager you place is solely with third parties, at your own risk, and only if that wager is lawful for you. You are solely responsible for knowing and following the gambling laws that apply to you.

Brickz Daily is not liable for bets you place, losses you incur, missed bets, odds movement, or any injury that follows from relying on a pick.

6. Past results

The house record, units, hit rate, streaks, and the wall are historical illustrations only. Past bricks do not predict future results. Records may include pushes, pending games, and later corrections. We may correct obvious errors.

7. No guarantee / “AS IS”

The service, the picks, their timing (target 8:00 AM America/Phoenix), and availability are provided AS IS and AS AVAILABLE. We may miss a day, change a pick, be late, or be wrong.

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted access.

8. Accounts

You must use a unique email, username, and phone. One live account per phone. You are responsible for your password and for all activity on the account. We may suspend or close accounts — including for being under 21, abuse, or suspected fraud — without refund except where law requires it.

9. Fees, trial, cancellation, no refunds

New accounts start with a 3-day free trial. The trial is once per phone. You can come back paid on a new account. Deleting does not mint a new trial on that number. After the trial, Brickz Daily is $10 per month. Cancel anytime. You keep access through the paid period after you cancel, until that period ends. Cancel during the trial before day 3 and you will not be charged.

A monthly rate already in force before this posting stays until that subscription is canceled, paused, or changed. We do not advertise that rate.

You may prepay 6 months at $48 or 12 months at $72. That term is one charge. No refund of unused prepaid time except where law requires. When the term ends, the plan continues at $10 per month unless you cancel.

You may pause billing for three months. A pause is not a cancel. You keep access through the current paid period. After that, access sits until billing resumes on its own. A pause is not a refund. Cancel if you do not want billing to come back.

Brickz Daily is a 21+ information product, not a sportsbook. Picks are opinions. Nothing here is a lock, a guarantee, a promise of results, or a recommendation to wager.

No refunds for the current period, unused days, or losing picks, except where required by law. Canceling the newsletter does not cancel the paid plan. Canceling the paid plan does not cancel the newsletter.

10. Limitation of liability

To the maximum extent permitted by law:

OmniPlay LLC, its members, officers, employees, and contractors are not liable for betting losses, lost profits, lost data, or any indirect, incidental, special, consequential, punitive, or exemplary damages, even if advised of the possibility of those damages.

Our total aggregate liability for all claims in the aggregate shall not exceed the greater of (a) the fees you actually paid to OmniPlay LLC for Brickz Daily in the twelve (12) months before the claim or (b) ten US dollars ($10).

These limits apply to claims in contract, tort (including negligence), strict liability, and any other theory, and they survive termination of these terms and of your account.

Some jurisdictions do not allow certain exclusions or limitations of liability. In those places, the limits apply to the fullest extent allowed. Arizona consumers keep any non-waivable statutory rights.

11. Indemnification

You will defend, indemnify, and hold harmless OmniPlay LLC and its members and officers from claims, damages, losses, and reasonable attorneys’ fees arising from your use of Brickz Daily, your wagers, your violation of these terms or of law, or your content.

12. Intellectual property

The site, the picks, the analysis, the wall, and the branding are OmniPlay LLC’s. Your license is personal, non-commercial subscription use only. You may not republish, resell, scrape, or share the daily pick as a competing tip service. You may not republish, resell, scrape, or share live odds, public ticket or money percentages, or other widget data from this site as a competing service or data feed.

13. Dispute resolution / Arizona law

Arizona law governs these terms, without regard to conflict-of-law rules. Exclusive venue is the state or federal courts in Maricopa County, Arizona. You consent to personal jurisdiction there.

Class action waiver: you may sue only in your individual capacity, not as a plaintiff or class member in any class, collective, or representative proceeding.

Jury waiver: to the extent allowed by law, you and OmniPlay LLC waive any right to a jury trial.

Arbitration. Except for the small-claims carve-out below, any dispute arising out of or relating to these terms or Brickz Daily shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The seat of arbitration is Maricopa County, Arizona. The arbitrator may award the same individual relief a court could award, and may not preside over any class or representative proceeding.

Small-claims carve-out: either of us may bring an individual action in small-claims court in Maricopa County, Arizona, if the claim qualifies.

Opt-out: you may reject arbitration by emailing hello@omniplay.llc within thirty (30) days of first agreeing to these terms. The email must include your account email and a clear statement that you opt out of arbitration. If you opt out, the court venue, class-action waiver, and jury waiver above still apply.

14. Limitation on claims

Any claim arising out of or relating to these terms or Brickz Daily must be filed within one (1) year after it accrues, or it is permanently barred, to the extent allowed by law.

15. Changes

We may update these terms. The posted date is the effective date. Continued use after that date is acceptance. For material changes, we may email the address on the account.

16. Termination

We or you may end access at any time. Sections that by their nature should survive — including limitation of liability, indemnification, intellectual property, dispute resolution, limitation on claims, severability, and this survival clause — survive termination.

17. Severability / entire agreement / no waiver

If a provision is held unenforceable, it is modified to the minimum extent needed to make it enforceable, or severed, and the rest remains in force. These terms and the Privacy policy are the entire agreement between you and OmniPlay LLC about Brickz Daily. They replace any prior understandings. Failure to enforce a provision is not a waiver. Any waiver must be in writing.

18. Force majeure

OmniPlay LLC is not liable for delay or failure to perform caused by events beyond its reasonable control, including outages, labor disputes, acts of government, failure of vendors, or other force majeure.
